According to ACCK, there are violations on the way of evaluating the offers, based mainly on the criteria of lowest cost, despite of the fact that the Law on Public Procurement foresees allocation of tenders for economically favored operators.
“The American Chamber emphasizes that the violations in the public procurement, by favoring certain economic operators, present violation of legal provisions of Law on Public Procurement and violate the Constitution, which obliges the institutions to provide a favorable legal environment for market economy and the freedom of economic activity, as well equal legal rights for all investors and all local and foreign enterprises,” reads the press release.
According to press release, this is against the legal dispositions of the Law, which requests from contracting authorities to draft the technical specifications in order to provide more access for all interested operators and bidders, and at the same time it prevents the contracting authorities from drafting technical specifications in the way of favoring one or more economic operators.
